Introduction

Welcome to HouseofHend.com. In using HouseofHend.com you are deemed to have accepted the terms and conditions listed below. All products/services and information displayed on HouseofHend.com constitute an "invitation to offer". Your order for purchase constitutes your "offer" which shall be subject to the terms and conditions as listed below. HouseofHend.com reserves the right to accept or reject your offer. If you have supplied us with your valid email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm details and therefore process the order. Our acceptance of your order will take place upon dispatch of the product(s) ordered. No act or omission of HouseofHend.com prior to the actual dispatch of the product(s) ordered will constitute acceptance of your offer.

Membership Eligibility

Use of the Site is available only to persons who have the capacity to contract under the applicable law. As per the Local Contract Acts, persons, who do not have the capacity, are not eligible to use the Site:

• Minors above 13 years old may use this Site only under the supervision of a parent or a legal guardian who agrees to be bound by these Terms of Use.
• Minors below 13 years old are prohibited from purchasing any material. Your parents or legal guardians can transact on behalf of you if they are registered users/members.
• Adults cannot purchase any material for a minor which is for adult consumption.

HouseofHend.com reserves the right to terminate your membership and refuse to provide you with access to the Site if HouseofHend.com discovers that these terms are not respected. The Site is not available to persons whose membership has been suspended or terminated by HouseofHend.com for any reason whatsoever. Those who choose to access this Site from outside UAE are responsible to comply with local laws to the extent local laws are applicable. By using the services of HouseofHend.com you agree to be bound by the Terms and Conditions.

Account and Registration Obligations

"Your Information" is any information you provide to us in the registration, buying or listing process, in the feedback area or through any email feature. We will protect Your Information in accordance with our Privacy Policy. You are responsible for maintaining the confidentiality of Your Account and Password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under Your Account or Password. If you know or suspect that someone else knows your password you should notify us immediately. You agree to provide true, accurate, current and complete information about yourself and to keep it updated. If you provide information that is untrue or inaccurate, HouseofHend.com may suspend or terminate your membership.

Pricing Information

While HouseofHend.com strives to provide accurate product and pricing information, pricing or typographical errors may occur. We cannot confirm the price of a product until after you order. If a product is listed at an incorrect price, we have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless it has already been dispatched. If we accept your order, the amount will be debited to your card and notified to you by email. If we cancel an order after payment, the amount will be reversed back to your card account; no cash disbursement will be made under any condition. Prices and availability are subject to change without prior notice.

Cancellation by HouseofHend.com

There may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason — for example limitations on quantities, inaccuracies in product or pricing information, or problems identified by our credit and fraud avoidance team. We will contact you if all or part of your order is cancelled or if additional information is required. If your card has already been charged, the amount will be reversed back to your card account.

Cancellations by the Customer

If we receive a cancellation notice before the order has been processed/approved, we will cancel the order and refund the entire amount. We will not be able to cancel orders that have already been processed and shipped. HouseofHend.com has the full right to decide whether an order has been processed.

Credit Card Details

You confirm that the credit card details provided by you are correct and accurate and that you use only a card lawfully owned by you. This information will not be shared with third parties unless required for fraud verification or by law, regulation or court order. HouseofHend.com will not be liable for any credit card fraud; the liability for fraudulent use of a card rests with you.

Fraudulent / Declined Transactions

HouseofHend.com reserves the right to recover the cost of goods, collection charges and lawyers' fees from persons using the Site fraudulently, and to initiate legal proceedings for fraudulent use or any other unlawful acts in breach of these terms.

Foreign Transactions

If the credit card used is issued outside the UAE, the transaction has to be verified with the card-issuing bank before delivery. Verification takes 3–10 working days depending on the bank's response. To avoid delays we may request a copy of your passport, driving licence or national ID, and the front side of the credit card (never the back). For a corporate card, an official email from senior management may be required. If the requested documents are not provided, the order will be held until the bank confirms the transaction.

You Agree and Confirm

• If a non-delivery occurs because of wrong information you provided (name, address, etc.), any extra cost incurred for redelivery may be claimed from you.
• You will use the services for lawful purposes only and comply with all applicable laws and regulations.
• You will provide authentic and true information wherever requested; we reserve the right to validate it at any time.
• You are accessing the services and transacting at your sole risk, using your best and prudent judgment.
• The delivery address you provide is correct and proper in all respects.
• Before placing an order you will check the product description carefully; by ordering, you agree to the conditions of sale in the item's description.

Prohibited Uses

You may not use the Site to disseminate unlawful, harassing, libellous, abusive, threatening, harmful, vulgar or obscene material; to encourage conduct that constitutes a criminal offence or breaches any law; to gain unauthorised access to other computer systems; to interfere with any other person's use of the Site or with networks and websites connected to it; or to make, transmit or store copies of copyrighted material without the owner's permission.

Colours

We have made every effort to display the colours of our products as accurately as possible. However, as the actual colours you see depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

Modification of Terms

HouseofHend.com may modify these Terms & Conditions at any time without prior notification. You can access the latest version at any time on the Site and should review them regularly. If the modified terms are not acceptable to you, you should discontinue using the service; continued use means you accept the modified terms.

Governing Law and Jurisdiction

This User Agreement is construed in accordance with the applicable laws of the UAE. The courts at Dubai have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute shall be referred to an independent arbitrator appointed by House of Hend, whose decision shall be final and binding; the arbitration shall be held in Dubai.

Reviews, Feedback, Submissions

All reviews, comments, feedback, suggestions, ideas and other submissions disclosed or offered to HouseofHend.com through the Site shall be and remain HouseofHend.com's property, and constitute an assignment of all worldwide rights in them. We may use, reproduce, disclose, modify, publish, display and distribute any such comments for any purpose, without restriction and without compensating you. We are under no obligation to keep any comments confidential, to pay compensation, or to respond. You agree your submissions will not violate any third-party right or contain unlawful, defamatory or obscene material, and you remain solely responsible for their content.

HouseofHend.com, its suppliers and licensors reserve all intellectual property rights in all text, programs, products, processes, technology, content and other materials on this Site. All rights, including copyright, are owned by or licensed to HouseofHend.com. Any use of this website or its contents — including copying or storing it in whole or part — other than for your own personal, non-commercial use is prohibited without our permission. The House of Hend names, logos and related product and service names, design marks and slogans are the trademarks or service marks of House of Hend. Access to this Site does not authorise anyone to use any name, logo or mark in any manner.

Objectionable Material

You understand that by using this Site you may encounter content that some may deem offensive, indecent or objectionable. You use the Site at your sole risk, and to the fullest extent permitted by law HouseofHend.com and its affiliates shall have no liability to you for such content.

Indemnity

You agree to defend, indemnify and hold harmless HouseofHend.com, its employees, directors, officers and agents from and against any claims, liabilities, damages, losses, costs and expenses (including attorney's fees) arising out of your actions or inactions, your breach of any warranties or obligations under this agreement, or your violation of any applicable laws or third-party rights. This clause survives the expiry or termination of this agreement.

Termination

This User Agreement is effective unless and until terminated by either you or HouseofHend.com. You may terminate it at any time by discontinuing use of the Site. HouseofHend.com may terminate it immediately without notice and deny you access, without any liability. Termination does not cancel your obligation to pay for products already ordered.

Transaction Currency

The standard transaction currency is UAE Dirham (AED). If you use a credit card issued by a bank outside the UAE, the amount on your card bill may differ due to exchange-rate fluctuations and any charges the card issuer may apply.
